O'Neill McFadden & Willett, LLP Wins Employment Law Case in the Seventh Circuit

Randy Nye and Dan Glavin represent a trucking company which was sued by a former employee for racial harassment, discrimination and retaliation in violation of the Civil Rights Act of 1964. The plaintiff was a truck driving instructor who claimed that he was fired in retaliation for making complaints about racial slurs. The employer contended that employment was terminated because of attendance issues. Mr. Nye and Mr. Glavin obtained summary judgment in federal district court and successfully defended that decision in the United States Court of Appeals for the Seventh Circuit. The appellate court agreed that the employee had failed to identify any similarly situated co-workers who were treated more favorably, and that the proximity between the employee's complaint and his termination was insufficient to establish that his termination was a pretext for retaliation.
